A senior official in President Donald Trump\u2019s administration has formally referred Rep. Eric Swalwell (D-CA) to the Justice Department for a possible federal criminal investigation. The referral centers on allegations of mortgage and tax fraud tied to a home in Washington, D.C.<\/p>\n
In a letter sent Wednesday to Attorney General Pam Bondi, Federal Housing Finance Agency Director Bill Pulte claimed Swalwell may have submitted false or misleading information on multiple loan documents according to\u00a0NBC News. The matter has also been forwarded to the agency\u2019s acting inspector general.<\/p>\n
The action arrives amid Trump\u2019s continued public calls for the prosecution of his political rivals. Pulte has already submitted referrals for a number of prominent Trump critics \u2014 New York Attorney General Letitia James, Sen. Adam Schiff of California, and Federal Reserve Governor Lisa Cook, a Biden nominee \u2014 all on similar mortgage-fraud allegations. Each has denied any wrongdoing.<\/p>\n
According to the referral, Swalwell executed several million dollars in loans and refinancing deals by listing his primary residence as Washington, D.C. It seeks a full investigation into potential mortgage fraud, tax fraud at both the state and local level, insurance fraud, and any related offenses.<\/p>\n
\u201cAs the most vocal critic of Donald Trump over the last decade and as the only person who still has a surviving lawsuit against him, the only thing I am surprised about is that it took him this long to come after me,\u201d Swalwell said in a statement on X.<\/p>\n
\u201cLike James Comey and John Bolton, Adam Schiff and Lisa Cook, Letitia James and the dozens more to come \u2014 I refuse to live in fear in what was once the freest country in the world,\u201d Swalwell added, referencing previous targets of the administration. \u201cOf course, I will not end my lawsuit against him. And I will not stop speaking out against the President and speaking up for Californians.\u201d<\/p>\n
Swalwell is now the fourth Democrat in recent months to face mortgage-related accusations.<\/p>\n
Fannie Mae officials who were recently pushed out of their roles had been investigating whether Trump appointee Bill Pulte improperly obtained mortgage files belonging to prominent Democrats, including New York Attorney General Letitia James, according to people familiar with the situation who spoke with\u00a0The Wall Street Journal\u00a0this week.<\/p>\n
The company\u2019s ethics and investigations unit had received internal complaints claiming that senior leaders directed staff to pull the mortgage records of James and others, the people said. Investigators were working to determine who issued the directives, whether Pulte had the authority to request the documents, and if proper procedures were followed, according to those familiar with the probe.<\/p>\n
Trump and Swalwell have had one of the most openly adversarial relationships in modern Washington politics. Their dynamic has never been cordial or cooperative \u2014 it has been defined from the start by public attacks, investigations, and high-profile political clashes. During Trump\u2019s presidency, Swalwell became one of his loudest Democratic critics, repeatedly accusing Trump of undermining democratic norms and even suggesting he had \u201ca compromised relationship\u201d with Russia.<\/p>\n
Swalwell\u2019s role only grew after he became one of the House impeachment managers during Trump\u2019s second impeachment, putting him directly at the center of the effort to remove Trump from office.<\/p>\n
Trump, for his part, has frequently mocked, attacked, or dismissed Swalwell, treating him as a political foe and a symbol of Democratic opposition. Their feud intensified during congressional investigations into Trump\u2019s conduct, as Swalwell used his committee positions to scrutinize Trump, his advisers, and his policies. Former FBI boss James Comey jotted a bombshell note weeks before the 2016 election \u2014 scribbling \u201cHRC plans to tie Trump\u201d and \u201cHRC health\u201d \u2014 and then allegedly hid it away in a dusty bureau safe until the week of Donald Trump\u2019s 2025 inauguration, newly unsealed court filings claim.<\/p>\n
The handwritten memo, dated Sept. 26, 2016, and stamped with the FBI director\u2019s seal, surfaced in federal filings tied to Comey\u2019s prosecution. A grand jury in Alexandria, Va., indicted him on Sept. 25 on counts of making false statements and obstruction of justice.<\/p>\n
The entry came just 19 days after Comey was briefed on a Sept. 7, 2016, CIA referral warning that Hillary Clinton\u2019s campaign intended to link Trump to Russia to distract from her private email scandal \u2014 the very plan prosecutors say Comey later pretended not to know about.<\/p>\n
Comey, reached through his publisher Mysterious Press, did not respond to a request for comment.<\/p>\n

The\u00a0filings\u00a0accuse FBI insiders of working to bury records tied to the bureau\u2019s election-year probes into both Trump and Clinton. The explosive note turned up in Room 9582 \u2014 a \u201cseemingly unused\u201d classified vault \u2014 after a reform team got a tip in early 2025, investigators said.<\/p>\n
Inside the forgotten room, agents found Comey\u2019s note and the original CIA tip file, formally known as a Counterintelligence Operational Lead. Access logs showed the room hadn\u2019t been touched in ages \u2014 until a sudden burst of activity in the days around Trump\u2019s 2025 swearing-in.<\/p>\n
Another newly filed exhibit includes a July 21, 2025, request from the FBI\u2019s public corruption unit to investigate bureau personnel for concealing or removing documents. That referral notes the CIA alert once believed missing was first stashed in a closet near Comey\u2019s office before being moved to Room 9582.<\/p>\n
Comey insisted under oath before the Senate Judiciary Committee on Sept. 30, 2020, that he knew nothing about Clinton\u2019s plan. \u201cIt doesn\u2019t ring any bells with me,\u201d he testified.<\/p>\n
The supposed \u201cClinton plan intelligence\u201d first surfaced publicly in 2020 when then-DNI John Ratcliffe declassified it. According to Ratcliffe \u2014 now CIA director \u2014 U.S. agencies learned in July 2016 that Russian operatives believed Clinton had approved a scheme to smear Trump by tying him to Moscow\u2019s election meddling.<\/p>\n
More records were made public in July 2025 by DNI Tulsi Gabbard showing Russia\u2019s foreign intelligence service reported Democratic leaders \u2014 including President Barack Obama \u2014 were \u201cextraordinarily alarm[ed]\u201d by Clinton\u2019s health issues and feared a \u201cserious negative impact\u201d on her chances. Russian analysts claimed she suffered \u201cintensified psycho-emotional problems, including uncontrolled fits of anger, aggression, and cheerfulness,\u201d and relied on \u201cheavy tranquilizers.\u201d They also alleged she battled \u201cType 2 diabetes, ischemic heart disease, deep vein thrombosis and chronic obstructive pulmonary disease,\u201d according to a House Intelligence Committee report.<\/p>\n
The filings also reveal that five burn bags in Room 9582 were stuffed with hundreds of pages tied to Crossfire Hurricane \u2014 the FBI\u2019s 2016 Trump-Russia probe.
