The Department of Justice has filed a lawsuit against the state of Minnesota and Democratic Governor Tim Walz, challenging a program that provides financial aid to undocumented immigrants pursuing higher education. The move marks the latest front in the DOJ’s legal campaign against state-level policies that extend benefits to those living in the country illegally.

The lawsuit, announced Friday, argues that Minnesota’s program violates the rights of U.S. citizens by offering tuition and financial benefits to undocumented students. Attorney General Pam Bondi framed the case as a defense of American citizens’ rights.

“No state can be allowed to treat Americans like second-class citizens in their own country by offering financial benefits to illegal aliens,” Bondi said in a statement. “The Department of Justice just won on this exact issue in Texas, and we look forward to taking this fight to Minnesota in order to protect the rights of American citizens first.”

The legal action targets the Minnesota Dream Act, passed in 2013, which allows undocumented immigrants to access in-state tuition rates and state financial aid if they meet certain criteria. According to the DOJ’s filing, the law discriminates against U.S. citizens who are not residents of Minnesota, noting that “the magnitude of this discrimination against U.S. citizens is substantial.” The lawsuit also names the Minnesota Office of Higher Education and State Attorney General Keith Ellison as defendants.

Governor Walz, who was the Democratic vice-presidential nominee in the unsuccessful 2024 election, has defended the state’s commitment to inclusivity but recently acknowledged that the message he and his running mate carried last year “was not ready” for the country at large.

The lawsuit arrives amid a broader push by the Trump administration to curtail benefits for undocumented immigrants. In April, President Trump issued an executive order directing federal agencies to review and eliminate “laws, regulations, policies, and practices” that give preference to non-citizens.

The DOJ’s legal strategy has been bolstered by a Supreme Court decision on Friday that limits federal judges’ ability to issue nationwide injunctions against executive actions. The 6–3 ruling, with all six Republican-appointed justices in the majority, restricts lower courts from blocking federal policies across the country, a tool frequently used to halt Trump’s directives in the past.

Bondi praised the ruling as a “historic win,” writing on X that it would end the “endless barrage of nationwide injunctions against President Trump” and allow the administration to enforce its policies while legal challenges play out.

The ruling directly impacts challenges to Trump’s executive order restricting birthright citizenship. Issued early in his second term, the order asserts that the 14th Amendment’s guarantee of citizenship to those born on U.S. soil applies only to children with at least one parent who is a U.S. citizen or lawful permanent resident. The policy, if upheld, would deny automatic citizenship to an estimated 255,000 babies born annually to undocumented immigrants or temporary visa holders, according to the Migration Policy Institute.

The Supreme Court is expected to take up the birthright citizenship case during its upcoming session in October, following oral arguments earlier this year. Bondi predicted that the high court will soon provide a final resolution.

For now, Minnesota finds itself at the center of a legal and political battle testing the boundaries of state authority, federal power, and the rights of undocumented immigrants—an issue likely to reverberate nationwide as the administration seeks to reshape immigration and citizenship policy.
