He claimed that he attempted to pass through the intersection before the light turned red but was unable to make it in time, as the light turned just as he was crossing.

Mr. Tercios presented a defense that included a picture of his car at the scene of the violation. The photo clearly showed a passenger in the vehicle wearing a hat, which he believed could support his claim that he was driving a friend and was distracted by the presence of his passenger.
